Restraining Orders

A Northern California Domestic Violence Lawyer

At my firm, William P. Davis, Attorney at Law, I help victims of domestic violence and their families obtain restraining orders. I also represent people in civil hearings who have been accused of domestic abuse.

Whatever your situation, you need effective legal representation. Doing nothing or representing yourself in these types of cases is not advised.

Contact our Northern California restraining orders attorney today for a FREE consultation by filling out our online form or calling (925) 313-0337. Our office is located in Martinez, California, and we serve clients throughout the East Bay Area.

Obtaining a Restraining Order

There are two steps to obtaining a restraining order:

1.) You can get a temporary restraining order (called an ex parte order) by filing papers with the court. You can do this yourself or we can help you.

2.) About two weeks or so after the issuance of the temporary order, a hearing will be held regarding a final restraining order.

At this second hearing, it is essential to have legal representation, because your petition will probably be vigorously challenged and must have real substance for the court to approve it. As your lawyer, I can present evidence, cross-examine witnesses and argue on your behalf.

Defending Against False or Exaggerated Claims of Abuse

During a divorce or custody dispute, one party can make false or exaggerated claims of domestic violence in order to gain an advantage. If a temporary restraining order has been issued against you, you must have strong legal representation in the hearing for the final order. Attempting to represent yourself is not a good idea — if the final order is issued, you can lose your custody or visitation rights, lose the ability to own a firearm, and suffer other adverse effects.

I can represent you — presenting evidence in your favor and challenging the assertions contained in the petition. My goal will be to prevent the issuance of the order. If this is not possible, I will work to limit the conditions that are placed on you and make the order as narrow as possible.
