There are two steps to obtaining a restraining order:
1.) You can get a temporary restraining order (called an ex parte order) by filing papers with the court. You can do this yourself or we can help you.
2.) About two weeks or so after the issuance of the temporary order, a hearing will be held regarding a final restraining order.
At this second hearing, it is essential to have legal representation, because your petition will probably be vigorously challenged and must have real substance for the court to approve it. As your lawyer, I can present evidence, cross-examine witnesses and argue on your behalf.
During a divorce or custody dispute, one party can make false or exaggerated claims of domestic violence in order to gain an advantage. If a temporary restraining order has been issued against you, you must have strong legal representation in the hearing for the final order. Attempting to represent yourself is not a good idea — if the final order is issued, you can lose your custody or visitation rights, lose the ability to own a firearm, and suffer other adverse effects.
